Acceptable Use Policy

Nstdata's websites, dashboard, APIs, SDKs, proxy network, crawling infrastructure, routing tools, and related services (collectively, the "Services") are intended for legitimate, lawful, and responsible use only.

This Acceptable Use Policy ("AUP") forms part of the Nstdata Terms of Use at https://nstdata.io/terms (the "Terms"). Capitalized terms not defined here have the meanings given in the Terms.

Nstdata was formerly known as Nstproxy. References to Nstproxy may be treated as references to Nstdata.

Nstdata takes firm action against illegal, fraudulent, abusive, harmful, or non-compliant use. We may investigate suspected violations, restrict traffic, suspend or terminate accounts, preserve records, and cooperate with law enforcement, regulators, providers, rights holders, and affected third parties where legally required or reasonably necessary.

Your responsibility

You are responsible for how you and your Authorized Users use the Services, including the targets you access, the data you collect, your crawl depth, request volume, routing, proxy type, fingerprints, headers, and downstream use of any data, logs, or outputs.

You must have all rights, permissions, authorizations, notices, consents, and lawful bases required for your use. Nstdata does not grant rights to access any third-party website, account, database, service, content, or personal data. A proxy, crawler, router, SDK, dashboard, or technical capability does not make otherwise prohibited activity acceptable.

Prohibited activities

You must not use, or allow anyone to use, the Services for any unlawful, harmful, abusive, deceptive, infringing, or unauthorized purpose. Prohibited activities include, but are not limited to:

• Illegal or fraudulent activity, or activity that violates laws, third-party terms, contractual obligations, or the rights of others.

• Collecting non-public information, including data behind a login, authentication wall, paywall, private API, private account, or other restricted area, unless you have authorization and a lawful basis.

• Collecting, processing, selling, or disclosing personal data without a valid lawful basis, required notices, consents, agreements, and safeguards, or collecting sensitive or regulated data unless expressly permitted by law and approved by Nstdata where required.

• Denial-of-service attacks, traffic flooding, unauthorized vulnerability scanning, credential stuffing, brute force attacks, account takeover, token theft, cookie theft, or activity that disrupts or compromises a system, network, service, or user.

• Bypassing authentication, authorization, paywalls, account limits, technical protection measures, rate limits, blocks, security controls, or access restrictions without authorization.

• Creating, distributing, hosting, retrieving, executing, or facilitating malware, ransomware, spyware, botnets, exploit kits, phishing kits, malicious scripts, or other harmful code.

• Spam, unsolicited bulk messages, deceptive promotions, phishing, fraudulent communications, ad fraud, click fraud, search-result manipulation, fake traffic, fake accounts, fake reviews, fake followers, fake likes, fake comments, fake shares, fake views, or other inauthentic engagement.

• Impersonation, spoofing, misrepresenting identity or affiliation, hiding the source of fraudulent activity, or deceiving users, platforms, advertisers, payment processors, or third parties.

• Automated ticket purchasing, queue manipulation, scalping, ticket bots, illegal raffles, lottery, gambling, betting, prize promotions, or manipulation of trading, voting, polling, gaming, virtual currency, or digital marketplaces.

• Accessing, transmitting, storing, retrieving, distributing, promoting, or facilitating illegal content, child sexual abuse material, sexual content involving minors, non-consensual intimate content, stolen data, leaked credentials, payment card data, pirated software, illegal downloads, torrent distribution, counterfeit goods, illegal drugs, weapons, or other illegal commerce.

• Infringing intellectual-property, database, confidentiality, privacy, publicity, or contractual rights, including by copying, archiving, republishing, downloading, sharing, or distributing content without required permission.

• Reselling, sublicensing, renting, leasing, redistributing, sharing, or providing the Services to third parties without Nstdata's prior written approval or an applicable order form.

• Copying, modifying, framing, mirroring, reverse engineering, decompiling, disassembling, benchmarking, monitoring, or testing the Services for competitive purposes without Nstdata's prior written consent.

• Creating fake, duplicate, disposable, automated, or misleading accounts; abusing trials, credits, promotions, referrals, discounts, or bonuses; or using stolen payment methods, unauthorized cards, compromised accounts, chargebacks, payment reversals, or false account information.

• Evading bans, cooldowns, enforcement actions, fraud checks, provider restrictions, target restrictions, or platform integrity rules for an unlawful, abusive, or unauthorized purpose.

• Any use that harms or risks harm to Nstdata, Nstdata users, Nstdata providers, third-party systems, target websites, networks, individuals, or the integrity, security, reputation, or availability of the Services.

Crawl, targets, and outputs

When using Crawl, Global Proxy, Proxy Manager, or related APIs, you are responsible for selecting target websites, URLs, crawl depth, frequency, concurrency, proxy settings, output formats, retention, and downstream processing.

You must not continue activity after a target service has clearly denied, revoked, blocked, or restricted your access unless you have authorization and a lawful basis. You are responsible for complying with target-site terms, access restrictions, intellectual-property rights, privacy rights, rate limits, contracts, and laws.

Outputs may be incomplete, inaccurate, delayed, blocked, formatted differently than expected, or unavailable. You are responsible for reviewing, validating, and deciding whether outputs are suitable and lawful for your use case.

Content, target, and technical restrictions

Nstdata may block, restrict, throttle, reroute, or refuse traffic to or from certain websites, domains, IP ranges, ports, protocols, countries, regions, content categories, use cases, or accounts. Examples may include unlawful, harmful, abusive, high-risk, restricted, or provider-prohibited destinations.

Use may also be subject to rate limits, concurrency limits, bandwidth limits, request limits, crawl-depth limits, target restrictions, fair-use controls, routing controls, product limits, plan limits, and other technical or operational restrictions. You must not bypass, disable, evade, overload, manipulate, or interfere with these controls.

Nstdata is not liable for limits, blocks, throttling, suspensions, rerouting, failed requests, unavailable targets, reduced performance, third-party blocks, CAPTCHAs, account actions, content changes, output failures, or restrictions imposed under this AUP, the Terms, provider requirements, or law.

Monitoring and enforcement

Nstdata may monitor Usage Data, logs, traffic patterns, account activity, payment activity, support communications, and technical signals to operate the Services, detect abuse, enforce this AUP, comply with law, and protect Nstdata, users, providers, and third parties.

If we believe you have violated this AUP, the Terms, an order form, provider requirements, or law, or if your use creates legal, security, operational, reputational, payment, abuse, or compliance risk, we may warn you, request information, block or throttle traffic, disable API keys or configurations, restrict targets, suspend or terminate access, revoke abusive credits, refuse refunds where permitted, preserve records, and cooperate with appropriate third parties.

We may take immediate action without prior notice where necessary to protect the Services, comply with law, respond to abuse, prevent harm, or protect network integrity.

Reporting abuse

Nstdata is committed to preventing misuse of our network. If you believe traffic from our Services is being used for abusive, fraudulent, or unlawful activity, please report it to us at abuse@nstdata.io. When reporting, please include the affected domain, URL, or IP address, the date and time of the activity (with time zone), and a description of the issue with any supporting evidence. We investigate all credible reports and take action, including suspension or termination of offending accounts, and where appropriate cooperate with law enforcement.

Changes to this AUP

We may update this AUP from time to time by posting an updated version with a new "Last Updated" date or by providing other reasonable notice. Your continued use of the Services after an update takes effect constitutes acceptance of the updated AUP. If you do not agree, you must stop using the Services.
